These Terms of Service (“Terms”) govern your use of the Regolith Audio website and store, operated by Summit Wave Software LLC (“we,” “us”). By using the site or purchasing a plugin, you agree to these Terms.

1. Accounts

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for activity that occurs under your account.

2. Purchases and licenses

Prices are shown at checkout. You are responsible for any applicable taxes, which are calculated and collected at checkout. Your use of any plugin you purchase is governed by our End User License Agreement. Payments are processed by our payment provider; by purchasing, you also agree to that provider’s terms.

3. Refunds

Purchases are covered by our Refund Policy.

4. Acceptable use

You agree not to misuse the site, interfere with its operation, attempt to gain unauthorized access, or use the site or plugins for any unlawful purpose.

5. Intellectual property

The site, the plugins, and all related content are owned by Summit Wave Software or its licensors and are protected by intellectual property laws. Except for the license expressly granted in the EULA, no rights are transferred to you.

The site and plugins are provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability arising out of or relating to the site or a plugin will not exceed the amount you paid us for the applicable product.

We may suspend or terminate your access to the site or your account if you breach these Terms. You may stop using the site at any time.

9. Changes

We may update these Terms from time to time. Continued use of the site after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules.
